These terms and conditions of sale apply to all orders placed on the website https://amongia.net.

They govern the rights and obligations of the seller and the customer in the context of the distance sale of products offered on the website, including board games, accessories, spare parts, and any other items offered for sale.

These Terms and Conditions apply to the exclusion of any other document, except for special conditions expressly accepted in writing by the seller.

Article 1 — Purpose

These terms and conditions of sale define the rights and obligations of the seller and the customer in the context of the online sale of products offered on the website https://amongia.net.

Their purpose is to define the terms relating to ordering, payment, delivery, withdrawal, warranties, mediation, and dispute resolution.

Article 2 — Products

The products offered for sale are those described on the website on the day the customer consults it, subject to stock availability.

Each product is described as accurately as possible. Photographs, visuals, illustrations, and colors are provided for informational purposes only and do not constitute an absolute contractual commitment unless expressly stated otherwise.

When certain products are sold second-hand, their condition, any visible defects, and specific characteristics are indicated in the product page or associated pre-contractual information.

Article 3 — Prices

Prices are indicated in euros including all taxes, excluding any delivery charges, unless otherwise stated before order validation.

The seller reserves the right to modify prices at any time. Products are nevertheless invoiced based on the rates in effect at the time the order is recorded.

Any delivery fees, surcharges related to the selected shipping method, or other additional costs are indicated before the final validation of the order.

Article 4 — Orders

The customer selects the products they wish to order, verifies the order summary, and validates it after having read these Terms and Conditions and the pre-contractual information.

The order becomes final and binding after payment validation and order confirmation by the seller.

The customer is solely responsible for the accuracy of the information provided, particularly the delivery address and contact details.

Article 5 — Acceptance of the Terms and Conditions

Validation of the order implies full acceptance of these terms and conditions of sale.

Article 6 — Payment

Orders are paid by bank card or any other payment method indicated on the website at the time of the order.

Payments may be processed through the secure Stripe payment platform.

Banking data is not stored by the website.

Payment is charged at the time the order is validated.

The seller reserves the right to suspend or cancel any order in the event of non-payment, payment incident, or suspected fraud.

Article 7 — Delivery

Delivery is made to the address provided by the customer when placing the order, according to the shipping method offered on the website.

Delivery times are indicated before order validation. They are provided as estimates unless a firm commitment is expressly stated.

Unless otherwise indicated before order validation, products are delivered within a maximum period of 30 days from the conclusion of the contract.

If the selected pickup point becomes unavailable after order validation (exceptional closure, saturation, temporary refusal by the carrier, or any other logistical constraint beyond AMONGIA’s control), another nearby pickup point may be proposed or assigned by the carrier.

AMONGIA cannot be held responsible for changes in pickup point availability made by partner carriers after order validation.

Depending on the customer’s location and logistical constraints, certain orders may be delivered either by a partner carrier or directly by the AMONGIA team.

In the context of direct delivery by AMONGIA, a delivery time slot may be proposed to the customer by email or any other contact method provided during the order. In the absence of a response from the customer within a reasonable period, a delivery attempt may be carried out according to AMONGIA’s availability. If the customer is absent during delivery, a delivery notice or a new delivery proposal may be communicated to the customer.

In the event of a delivery delay, the customer may formally request the seller to complete delivery within a reasonable time. Failing this, the customer may cancel the sale under the conditions provided by law.

Transfer of risk occurs when the customer physically takes possession of the goods.

In the event of a missing, damaged, or deteriorated product during transport, the customer is invited to contact customer service as soon as possible so that an appropriate solution can be provided.

Article 8 — Receipt of the Order

The customer must check the condition of the package and the conformity of the product upon receipt.

Any apparent anomaly, reference error, missing product, or visible damage must be reported to the seller within a reasonable time after delivery.

Article 9 — Right of Withdrawal

In accordance with regulations applicable to distance selling, the customer has a period of 14 days to withdraw without having to justify their decision.

For goods, this period begins on the day following receipt of the goods by the customer or a third party designated by them.

The right of withdrawal also applies to discounted goods, second-hand goods, and clearance goods, except where a legal exception applies.

Article 10 — Effects of Withdrawal

In the event of exercising the right of withdrawal, the seller reimburses the customer for all sums paid, including the initial delivery costs corresponding to the standard delivery method offered, within 14 days from the date on which the seller is informed of the withdrawal decision.

The seller may delay reimbursement until the goods are recovered or until the customer provides proof of shipment of the goods, whichever occurs first.

The direct costs of returning the goods remain the responsibility of the customer unless otherwise stated by the seller or expressly covered by them.

The customer is responsible for any depreciation in the goods resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the goods.

Article 11 — Legal Warranties

The customer benefits from the legal guarantee of conformity provided by articles L217-3 and following of the French Consumer Code.

The seller is required to deliver goods that conform to the contract and is liable for conformity defects existing at the time of delivery.

The customer has a period of two years from delivery of the goods to act under the legal guarantee of conformity.

For second-hand goods, the presumption of prior existence of the conformity defect is twelve months from delivery of the goods.

The customer may also invoke the warranty against hidden defects provided by articles 1641 and following of the French Civil Code.

In the event of a conformity defect or hidden defect, the customer may, under the applicable legal conditions, request repair, replacement, price reduction, or cancellation of the sale.

Any commercial warranty that may be offered by the seller is mentioned separately on the product page, order page, or a separate contractual document. Where it exists, it does not replace legal warranties.

Article 12 — Complaints

Complaints may be sent to the seller by email at customer-service@amongia.net or by post to the postal address indicated at the beginning of these Terms and Conditions.

The seller strives to process complaints as quickly as possible and provide an appropriate response.

Article 13 — Consumer Mediation

In accordance with applicable regulations, any consumer may use a consumer mediator free of charge after having first submitted a written complaint to the seller without success.

Consumer mediation is free for the consumer; the costs of the system are borne by the professional.

Article 14 — Liability

The seller’s liability cannot be engaged in the event of non-performance or improper performance of the contract attributable to the customer, particularly in the event of errors in the information provided during the order.

The seller’s liability cannot be engaged in cases of force majeure under French law.

The seller cannot be held responsible for the content of third-party websites to which hyperlinks may refer. These links are provided for informational purposes only.

Article 15 — Intellectual Property

All elements of the website, including texts, visuals, logos, illustrations, graphics, and content, remain protected by intellectual property law.

Any reproduction, representation, adaptation, or exploitation, in whole or in part, without prior written authorization from the seller, is prohibited.

Article 16 — Personal Data

Personal data collected in the context of orders or exchanges with customer service is used for order management, customer relations, invoicing, and compliance with legal obligations.

Article 17 — Applicable Law and Competent Jurisdiction

These terms and conditions of sale are governed by French law.

In the event of a dispute, and failing an amicable resolution, the consumer may refer the matter to the competent court in accordance with applicable legal rules. The competent court depends in particular on the consumer’s place of residence and the applicable procedural rules.

Article 18 — Archiving and Evidence

The seller will archive order forms and invoices on a reliable and durable medium constituting a faithful copy. The seller’s computerized records will be considered proof of communications, orders, payments, and transactions between the parties.

Article 19 — Final Provisions

If any clause of these Terms and Conditions is declared null or unenforceable, the remaining provisions shall remain in force.

The fact that the seller does not invoke at a given time any clause of these Terms and Conditions shall not constitute a waiver of the right to invoke it later.
